This Policy sets out how Walker Executive manages personal information, in accordance with the Australian Policy Principles contained in the Privacy Act 1988 (Cth) and (where applicable) the General Data Protection Regulation (EU) 2016/679 (GDPR).

We take the individual rights of candidates and other data subjects seriously. This Policy outlines our commitment to ensuring that your personal information is appropriately managed and protected.

In this Policy, the expressions ‘Walker Executive’, ‘we’, ‘us’ and ‘our’ are references to Walker Executive Pty Ltd t/as Natalie Walker Executive Search.

Walker Executive may need to amend this Policy from time to time in response to any legislative changes and technological advancements. If we do so, we will post the updated version on our website (www.walkerexecutivesearch.com) and it will apply to all of your personal information held by us at that time.

WHAT INFORMATION DO WE COLLECT?

Walker Executive uses personal information for the purposes of delivering our search, consulting and assessment services. We collect and hold personal information such as your name, date of birth, place of birth, contact details (including address, email address, phone number and mobile phone number), citizenship status, employment details, bank details, tax file number and passport number. We may also collect and hold information regarding your, qualifications, references, opinions about your work performance and behaviour, and other information obtained or received by us in connection with our services.

It may be necessary in some circumstances for Walker Executive to collect and use your sensitive information. Usually this will take the form of information about any memberships of trade unions or other professional associations, your criminal record and health, including your medical history and results of psychometric testing. Sensitive information will only be collected from you with your consent and as required by law.

HOW DO WE COLLECT YOUR INFORMATION?

We can collect your personal information from you directly. For example, you might provide this information to us when engaged in an executive search recruitment process with one of our clients. We may collect your personal information directly from you when we deal with you in person or over the phone, when you send us correspondence including via email and when you use our website.

The nature of our work means we may be required to collect your personal information from sources other than you where it is unreasonable or impracticable to collect it directly from you. For the purposes of the GDPR (where it applies), we will process your personal data where it is necessary to pursue our legitimate interests, and this may include where it is not possible to collect it from you as the data subject.

Sometimes we may collect your personal information from a third party. For example, we might be given personal information by one of our clients with whom you are seeking employment, your referees or third parties when they provide the results of testing or checks. We may also receive personal information from former employers, work colleagues, or professional associations. Other times we may collect your personal information from publicly available sources of information.

If we receive your personal information from a third party, we will take reasonable steps to make sure you know we have it, how we received it and how we will handle it.

Walker Executive holds personal information in hard copy and electronic formats. In addition, your personal information may be held by our data hosting and cloud-based information technology service providers in or outside of Australia. We take reasonable steps to maintain the security of your personal information and to protect it from unauthorised disclosures.

HOW DO WE USE YOUR PERSONAL INFORMATION?

Walker Executive uses your personal information for a number of purposes including in connection with verifying your identity, providing, administering and/or managing our services to you, performance appraisals, assessing your performance, testing or assessment (including medical and psychometric testing or assessment), undertaking criminal reference and other background checks, informing you of possible opportunities, developing or evaluating our services, managing our business, and complying with our legal obligations.

Additionally, we may use your personal information when you have subscribed to receive marketing material or information about our services, or you attend one of our events.

You are not obliged to provide us with the personal information we have requested; however, without such personal information we may not be able to complete or fulfil the purpose for which such information was collected, including (if you are a candidate) placing you in employment.

WHEN DO WE DISCLOSE YOUR PERSONAL INFORMATION?

The types of third parties to whom we may disclose your personal information include potential and actual employers, referees, third parties used to conduct testing, assessment or other background checks to assist us to provide our recruitment services to you, our insurers and any person with a lawful entitlement. We may also disclose it where required by law. In some cases, the persons and organisations to whom we may disclose your personal information may be based outside Australia.

HOW CAN YOU ACCESS OR CORRECT YOUR PERSONAL INFORMATION OR MAKE A COMPLAINT?

You can request access to your personal information at any time. We will need to verify your identity first. Such request must be made in writing to us.

There are some situations under the Privacy Act where we may not give you access to the personal information we hold about you. For example, where we believe that giving access would pose a serious threat to someone’s life, health or safety or where giving access would have an unreasonable impact on the privacy of other individuals.

If you believe that any personal information Walker Executive has collected about you is inaccurate, not up-to-date, incomplete, irrelevant or misleading, you should request correction in writing immediately. We will take reasonable steps to correct it in accordance with the requirements of the Privacy Act.

If you wish to make a complaint to Walker Executive about our handling of your personal information, you can contact the Walker Executive Data Administrator. You will be asked to set out the details of your complaint in writing so that we can investigate it.

Walker Executive will endeavour to resolve all investigations within a reasonable time. We may contact you during the investigation process to seek any further clarification. We will contact you to inform you of the outcome of the investigation.

If you are not satisfied with the outcome of your complaint, you can refer your complaint to the Office of the Australian Information Commissioner.
